These terms are provided for general information and may be updated.
These Terms of Service (“Terms”) govern your access to and use of PreTaskPlanner. Please read them carefully.
1. Acceptance of terms
By accessing or using PreTaskPlanner (“the service”), you agree to be bound by these Terms. If you do not agree, do not use the service.
2. The service
PreTaskPlanner provides AI-assisted pre-task safety plan generation, risk analytics, and a Safety Assistant for construction and industrial professionals. The service is operated by PreTaskPlanner LLC, a Delaware limited liability company (“the Company,” “we,” “us”).
3. Eligibility & professional use
The service is intended solely for safety and construction/industrial professionals aged 18 or older. By using the service you represent that you are at least 18 and are using it in a professional capacity.
4. Accounts
You are responsible for your account, for keeping your credentials secure, and for all activity that occurs under your account. Notify us promptly of any unauthorized use.
5. Acceptable use
You agree not to:
- use the service for any unlawful purpose;
- misuse, disrupt, or interfere with the service;
- attempt to breach security or access data belonging to other accounts or users; or
- copy, resell, or exploit the service except as expressly permitted.
6. Restricted data (CUI / regulated data)
The service is not authorized for the input, storage, transmission, or processing of Controlled Unclassified Information (CUI), classified information, ITAR or other export-controlled data, or any data subject to CMMC, NIST SP 800-171, FedRAMP, or equivalent federal information-security requirements. The service does not currently meet those requirements and is not represented as doing so. You are solely responsible for not entering restricted data into the service.
6.a Export Compliance. You agree to comply with all applicable export-control, sanctions, and trade laws when using the Service. You may not use the Service in any manner prohibited by United States or other applicable export-control regulations, nor provide access to individuals, organizations, or jurisdictions subject to applicable sanctions or legal restrictions.
7. Subscriptions & billing
The service offers a Free plan and paid monthly plans — Pro ($19 / month) and Max ($35 / month) — billed monthly through our payment processor, Stripe. Paid plans renew each month until canceled, and you may cancel at any time; cancellation takes effect at the end of the current billing period. Each plan includes usage limits. Except where required by law, payments are non-refundable.
During the beta period, the service may be offered free of charge; paid plans and billing may not yet be active.
8. Important Safety Disclaimer & Regulatory Compliance
PreTaskPlanner is an informational drafting and administrative aid powered by artificial intelligence. It is not a substitute for a qualified safety professional, a Certified Safety Professional (CSP), or an OSHA-designated “Competent” or “Qualified” Person.
The construction and industrial sectors are subject to strict, evolving regulatory frameworks. PreTaskPlanner does not warrant or guarantee that any generated plans, hazard analyses, or control recommendations comply with federal, state, or local regulations, including but not limited to OSHA standards (29 CFR 1926, 29 CFR 1910), MSHA (30 CFR), FRA (49 CFR), FAA (14 CFR), or USACE EM 385-1-1.
AI Limitations & Verification Required: AI-generated content can contain inaccuracies, omissions, or “hallucinations.” You acknowledge that all generated outputs are preliminary drafts. You assume absolute responsibility to independently review, verify, and modify all outputs against physical, site-specific conditions, localized weather, specific equipment manufacturer specifications, applicable manufacturer or operator manuals (such as an Aircraft Maintenance Manual), and professional human judgment before implementing them on an active jobsite. The user remains solely and exclusively liable for the actual safety of the work, workers, and site operations. Do not rely on this service as a final authority.
9. Intellectual property
You retain rights to the content you create using the service (your plans, inputs, and uploads). We retain all rights to the software, the service, and our underlying technology. These Terms do not grant you any rights to our trademarks or branding.
10. Warranty disclaimer
The service is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express or implied, including but not limited to fitness for a particular purpose, accuracy, or non-infringement.
11. Indemnification
To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless PreTaskPlanner LLC and its members, officers, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the service or any generated output, including any implementation of, or reliance on, output on an actual jobsite; (b) your violation of these Terms; or (c) your violation of any law or the rights of any third party.
12. Limitation of liability
To the maximum extent permitted by law, PreTaskPlanner LLC and its members, officers, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your use of (or inability to use) the service — including reliance on any generated output, consistent with the safety disclaimer above.
In addition, to the maximum extent permitted by law, the total aggregate liability of PreTaskPlanner LLC and its members, officers, and affiliates for any and all claims arising out of or related to the service will not exceed the greater of (a) the total amounts you paid to use the service in the twelve (12) months before the event giving rise to the claim, or (b) one hundred U.S. dollars (US$100).
13. Termination
You may stop using the service and close your account at any time. We may suspend or terminate access if these Terms are violated or as needed to operate the service. Sections that by their nature should survive (such as disclaimers, indemnification, and limitation of liability) will continue to apply.
14. Changes to terms
We may update these Terms from time to time. When we do, we will revise the “Last updated” date above. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.
15. Governing Law & Dispute Resolution
These Terms shall be governed by, and construed in accordance with, the laws of the State of Delaware, United States, without regard to its conflict of law principles. Any legal action, suit, or proceeding arising out of or relating to these Terms or your use of the service shall be instituted exclusively in the federal or state courts located in Wilmington, Delaware, and you irrevocably consent to the personal and exclusive jurisdiction and venue of such courts.
